Introduction

Welcome to Bloom Senior Homecare (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of our services and website. By engaging our services or accessing our website, you agree to comply with these Terms. If you do not agree with any part of these Terms, please do not use our services or website.

Services Provided

Bloom Senior Homecare offers non-medical homecare services to seniors, including but not limited to:

  • Companionship: Engaging clients in conversation, hobbies, and activities to provide social interaction and emotional support.
  • Personal Care: Assisting with bathing, grooming, dressing, and other personal hygiene tasks.
  • Meal Preparation: Planning and preparing nutritious meals tailored to clients’ dietary needs and preferences.
  • Light Housekeeping: Performing routine household chores such as cleaning, laundry, and organizing.
  • Transportation and Errands: Providing transportation for appointments, shopping, and other errands.
  • Medication Reminders: Ensuring clients take their medications as prescribed.
  • Respite Care: Offering temporary relief for primary caregivers by taking over their caregiving responsibilities for a specified period.

 

Eligibility

Our services are available to individuals who are 18 years of age or older. By using our services, you represent and warrant that you meet this age requirement.

Service Agreement

Before commencing services, clients must enter into a service agreement with Bloom Senior Homecare. This agreement outlines the specific services to be provided, the schedule of services, and the fees associated with those services. Both parties must sign the agreement to confirm their acceptance of the terms.

Payment Terms

Clients are required to pay for services according to the payment schedule outlined in the service agreement. Payments can be made by check, credit card, or electronic transfer. All payments are due upon receipt of the invoice. Late payments may incur additional charges, including a late fee of [Insert Percentage]% per month on the outstanding balance.

Cancellation and Refund Policy

Clients may cancel services by providing at least 24 hours’ notice. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee equivalent to [Insert Percentage]% of the scheduled service fee. Refunds for prepaid services will be issued at our discretion and may be prorated based on services already rendered.

Client Responsibilities

Clients are responsible for providing accurate and complete information about their health, preferences, and care needs. Clients must also ensure a safe environment for our caregivers and provide necessary supplies and equipment for the provision of services. This includes but is not limited to:

  • Ensuring the home is free of hazards that could cause injury to the caregiver.
  • Providing access to any necessary medical equipment or supplies.
  • Informing caregivers of any specific instructions related to care.
Caregiver Conduct

Our caregivers are trained professionals who are expected to provide compassionate and reliable care. Clients should treat caregivers with respect and report any concerns about caregiver conduct to Bloom Senior Homecare immediately. Caregivers are prohibited from:

  • Accepting personal gifts or money from clients.
  • Engaging in personal relationships with clients outside the scope of their professional duties.
  • Providing medical or clinical services beyond their training and certification.
Limitations of Liability

Bloom Senior Homecare will make every effort to provide high-quality care. However, we are not liable for any damages, losses, or injuries resulting from the provision of services, except where caused by our gross negligence or willful misconduct. Our liability is limited to the cost of services provided.

Indemnification

Clients agree to indemnify and hold harmless Bloom Senior Homecare, its employees, and agents from any claims, liabilities, damages, or expenses arising from the client’s use of our services, except where caused by our gross negligence or willful misconduct. This includes but is not limited to:

  • Claims related to personal injury or property damage.
  • Legal fees and costs incurred in defending against such claims.
Changes to Services and Terms

We reserve the right to modify or discontinue our services or these Terms at any time. We will provide notice of significant changes to clients. Continued use of our services after such changes constitutes acceptance of the new Terms. Clients are encouraged to review these Terms periodically for updates.

Governing Law

These Terms and the relationship between the client and Bloom Senior Homecare are governed by the laws of the state of Missouri, without regard to its conflict of laws principles. Any disputes arising from these Terms or our services will be resolved in the courts of St. Louis County, Missouri.

Entire Agreement

These Terms, along with the service agreement and Privacy Policy, constitute the entire agreement between the client and Bloom Senior Homecare. Any amendments or modifications to these Terms must be made in writing and signed by both parties. No verbal agreements or representations shall override these written Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. The invalid or unenforceable provision will be replaced by a valid, enforceable provision that most closely matches the intent of the original provision.

Waiver

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Bloom Senior Homecare to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
